Hungarian Government orders restrictions on entering premises


Government Decree No. 46/2020 (III.16.) came into effect on 17 March 2020, ordering prohibitions and restrictions on visiting certain premises.

Does the Government Decree provide for forced closure of any premises?


The Government Decree does not officially order that premises be closed to the public, but only provides for prohibitions and restrictions on entering certain areas by individuals. Nevertheless, in practice, this is likely to result in the (partial) closure of the premises affected.

Which sectors are affected by prohibitions?


The effected sectors are music or dance events, or any other events (excluding religious ceremonies, weddings and funerals), theatres, cinemas, and museums. In addition, sporting events may only be held behind closed doors.

Can these events be held if the number of persons attending is below a certain number?


No. The prohibitions apply irrespective of the number of persons that would be present.

Which sectors are affected by restrictions?


In general, premises qualifying as “shops” under the relevant laws may not be entered between 3 pm and 6 am of the next day, except for persons employed by the shop.

Are there any sectors exempt from the restriction?


Yes. In case of catering service providers, entrance is permitted between 3 pm and 6 am of the next day for the purpose and the duration of ordering and picking up and paying for takeaway food.

In addition, there are no restrictions relating to shops selling food products, perfumes, drugs, household cleaning products, chemicals and toilette paper products, as well as pharmacies and shops selling medical devices. Persons may enter these shops during normal opening hours.

What are the legal consequences of breaching the prohibitions or restrictions?


The police may enforce all measures provided for under Act on the Police in order to ensure that no person is present at the prohibited or restricted premises. In addition, a person breaching the prohibitions or restrictions can be obliged to pay a fine between HUF 5,000 (approx. EUR 14) to HUF 500,000 (approx. EUR 1,400).

When will the prohibitions and restrictions be lifted?


The Government Decree does not provide for an expiry date, therefore, the duration of these rules is currently uncertain.
